By accessing or using Bandloop ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. Bandloop ("we", "us", "our") is a service operated by an individual sole proprietor.
Bandloop uses YouTube API Services to help you find official music videos for songs in your catalog. By using Bandloop, you also agree to be bound by the YouTube Terms of Service.
Bandloop is a web application that helps bands manage their songs, setlists, gigs, venues, and payments. The Service is provided "as is" and may be updated, modified, or discontinued at any time.
Bandloop is offered as a free tier with optional paid subscription features ("Bandloop Pro"). We may change which features are free or paid at any time.
You may cancel a band's subscription at any time from Settings (via the Stripe billing portal). When you cancel, your subscription remains active until the end of the current billing period, after which it will not renew and you will not be charged again. Cancelling stops future charges but does not shorten the period you have already paid for.
All fees are non-refundable, and we do not provide refunds or credits for partial billing periods, unused features, or partially used subscription periods, except where required by law. If you believe you were charged in error, contact us at [email protected] and we will look into it.
You retain ownership of all content you create on Bandloop (songs, setlists, gigs, venues, etc.). By using the Service, you grant us a limited license to store and display your content as needed to provide the Service to you and your band members. You are responsible for the content you add and for having the rights to it.
You agree not to:
Bandloop integrates with third-party services including Google, YouTube, iTunes, Deezer, LRCLIB, Spotify, and Stripe. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability or accuracy of third-party services.
In particular, Bandloop's use of YouTube API Services is subject to the YouTube Terms of Service and the Google Privacy Policy.
Song lyrics, music videos, and other content fetched from third-party services are the property of their respective owners. Bandloop provides access to this content for personal, non-commercial use within the context of managing your band.
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any data (including third-party data such as BPM, lyrics, or videos) will be accurate or available.
To the maximum extent permitted by law, in no event will Bandloop or its operator be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of (or inability to use) the Service, even if advised of the possibility of such damages.
Bandloop's total aggregate liability for all claims relating to the Service will not exceed the greater of (a) the total amounts you paid to us for the Service in the twelve (12) months before the event giving rise to the claim, or (b) USD $50.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
You agree to indemnify, defend, and hold harmless Bandloop and its operator from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your content, your use of the Service, or your violation of these Terms or of any law or the rights of a third party.
We may suspend or terminate your access to the Service at any time for violation of these terms. You may stop using the Service at any time. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including payment obligations, disclaimers, limitation of liability, and indemnification) will survive.
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Before bringing any formal claim, you agree to first contact us at [email protected] and attempt to resolve the dispute informally in good faith. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in Contra Costa County, California, and you consent to their jurisdiction.
We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the new terms.
These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Service. If any provision is found unenforceable, the remaining provisions will stay in effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a transfer of the Service.
